Fair Purchase & Anti-Scalping Notice

Our Commitment to Fair Access
At Luma Collectibles, we believe TCG products should be accessible to collectors, players, families, children and hobbyists — not disproportionately purchased in bulk for the purpose of reselling sealed products at inflated prices.
We understand that highly sought-after TCG products can become difficult to obtain when limited stock is purchased in large quantities for resale. Our goal is to give as many members of the community as reasonably possible the opportunity to enjoy the products we stock.
Accordingly, Luma Collectibles may implement reasonable purchase limits on selected products, particularly limited-release, high-demand or allocation-restricted products.
These limits may apply on a per-order, per-customer, per-household, per-address, per-payment method or other reasonable basis where necessary to prevent circumvention.
1. Purchase Limits
Where a purchase limit applies, the applicable limit will be clearly displayed on the relevant product listing, promotional material or at checkout.
Examples may include:
- a maximum number of individual booster packs;
- a maximum number of booster boxes;
- a maximum number of ETBs or other sealed products;
- a maximum quantity across a particular product range; or
- another reasonable limit determined by Luma Collectibles based on available stock.
Purchase limits may vary between products depending on stock availability, supplier allocations, product demand and other legitimate business considerations.
A purchase limit applies to the total quantity purchased by the customer, rather than simply the quantity contained within an individual transaction.
2. Circumvention of Purchase Limits
Customers must not attempt to circumvent a stated purchase limit.
Circumvention may include, but is not limited to:
- placing multiple orders for the same restricted product;
- using multiple customer accounts;
- using different names or email addresses for substantially related orders;
- using multiple delivery addresses where the orders appear to originate from the same customer;
- using multiple payment methods for the purpose of exceeding a stated limit;
- placing repeated orders shortly after one another;
- coordinating multiple accounts or individuals to purchase stock on behalf of the same person; or
- otherwise attempting to obtain quantities beyond a stated purchase limit.
Luma Collectibles may review orders where there are reasonable grounds to believe that a purchase limit is being deliberately circumvented.
3. Commercial Resale & “Scalping”
Luma Collectibles is primarily a consumer-focused TCG and collectibles retailer.
Our intention is for our limited and high-demand products to reach people purchasing them for personal collecting, playing, opening, gifting or entertainment purposes.
For products subject to a purchase limit, Luma Collectibles may restrict or decline orders where there are reasonable grounds to believe that the customer is purchasing quantities primarily for commercial resale or profit-making purposes, particularly where doing so would undermine an advertised purchase limit or materially reduce fair access for other customers.
This may include circumstances where an order appears inconsistent with ordinary personal or household consumption, or where there is evidence of deliberate purchasing for the purpose of reselling sealed product at an inflated price.
Why we do this
Our policy exists to help prevent situations where a small number of buyers acquire a disproportionate amount of scarce stock and subsequently offer that sealed stock to other collectors, families or players at significantly increased prices.
We would rather see our products enjoyed by the TCG community than have limited stock concentrated among customers purchasing primarily for resale.
This policy does not mean that Luma Collectibles considers every person who later sells an unwanted item to be a “scalper”.
We recognise that customers may legitimately sell or trade items they personally own for many reasons.
Our concern is specifically with deliberate purchasing of limited stock for commercial resale, profit-making or circumvention of Luma Collectibles’ purchase limits.
4. Order Review & Cancellation
Where Luma Collectibles has reasonable grounds to believe that an order:
- exceeds an applicable purchase limit;
- has been placed to circumvent a purchase limit;
- has been duplicated for the purpose of obtaining additional restricted stock;
- has been placed primarily for commercial resale where a product is subject to a personal-purchase restriction; or
- otherwise materially conflicts with the purchase conditions displayed for the relevant product,
Luma Collectibles may place the order on hold while it is reviewed.
Where appropriate and legally permissible, Luma Collectibles may decline or cancel the affected order or affected portion of the order before dispatch.
Where an order is cancelled after payment has been received, Luma Collectibles will arrange a refund of the cancelled amount using the applicable payment method or another appropriate method.
5. No Penalty for Legitimate Customers
Luma Collectibles understands that legitimate customers may occasionally place more than one order for genuine reasons.
We will not automatically assume that multiple orders constitute scalping.
Where practical, Luma Collectibles may consider relevant circumstances before taking action, including:
- order timing;
- quantity purchased;
- applicable product limits;
- customer/order information;
- whether purchase limits have been exceeded;
- whether multiple orders appear connected; and
- other reasonably available information relevant to determining whether a restriction is being deliberately circumvented.
Our objective is fair allocation of limited stock, not to unfairly prevent genuine customers from purchasing products.
6. Product Limits May Change
Luma Collectibles reserves the right to introduce, modify or remove reasonable purchase limits based on:
- stock availability;
- supplier allocations;
- product demand;
- product release conditions;
- community accessibility;
- promotional requirements; and
- other legitimate business considerations.
Any applicable limit will be communicated to customers before or during the purchasing process wherever reasonably possible.
A purchase limit applying to one product does not automatically apply to every product sold by Luma Collectibles.
7. Orders Are Subject to Product Availability
Placing an order does not guarantee that Luma Collectibles will be able to supply an item where there is a genuine stock, availability or fulfilment issue.
If Luma Collectibles is unable to supply a product that a customer has paid for, we will provide an appropriate solution in accordance with applicable Australian Consumer Law.
Luma Collectibles will not use this policy to remove, restrict or exclude any consumer guarantee or other legal right that applies to a customer.
8. Australian Consumer Law
This notice operates subject to the Australian Consumer Law (ACL) and all other applicable Australian laws.
Nothing in this notice is intended to:
- exclude, restrict or modify a consumer guarantee;
- remove a customer’s statutory rights;
- prevent a customer from seeking a remedy they are legally entitled to receive;
- create a misleading impression about a customer’s rights; or
- permit Luma Collectibles to refuse a remedy required by law.
Australian consumers automatically receive consumer guarantees when purchasing eligible goods and services, and businesses cannot contract out of those rights. (ACCC)
Where Luma Collectibles cannot supply an order that has been paid for, applicable consumer-law obligations will continue to apply. (ACCC)
9. Our Philosophy
We created Luma Collectibles because we love TCGs and collectibles — and because we want our community to be able to enjoy them.
We know that sought-after releases can be frustrating to find, particularly for children, families, new collectors and people who simply want to open a pack, build a collection or enjoy the hobby.
Our purchase-limit policy is therefore intended to support:
Fair access.
Personal collecting.
Hobby enjoyment.
Community inclusion.
Less stock concentration.
We ask our customers to respect these limits so that more people have a genuine opportunity to participate in the hobby.
